This study aims to root Islamic education based on legislative science of jurisprudence, by extracting the foundations of Islamic educational legislative learned from the knowledge of legislative science jurisprudence directly, and in its various elements. The study concluded that the legislative bases for Islamic education as seen in the legislative science of jurisprudence are: in its Arabic tongue, and taking into account the gradual progress, selection, and priorities.
